Memorial for the Commissioners of the forfeited estates, and for the creditors on the estate of Seaforth, appellants : against Kenneth Mackenzie of Assint, and Colonel Mackenzie his guardian, respondents : proving that William late Earl of Seaforth, having by himself and his trustees possess'd the estate for near 20 years before his attainder, and no proof of his being a papist, or legal process at the suit of the Protestant heir all that time, that the estate, by Earl William's treason, became forfeited to the Crown, and ought to be sold for the use of the publick, and for payment of just and lawful creditors.
