- The purpose of this report is to describe the similarities and differences between 5 U.S.C. §§ 4303 and 7513, the two sections of the law that authorize an agency to take an adverse action against a Federal employee for poor performance. As history as shown, poor performers are a serious concern for the Federal workforce, and one that the Government has had difficulties addressing. The biggest obstacle to addressing poor performers in the Federal Government is not created by a statute, but rather is simply a question of how supervisors manage the performance of their employees. This report addresses the limited ability of the law to address the underlying challenges of a performance-based action and the importance of educating and encouraging supervisors to use better performance management practices. Federal employees, their supervisors, management, and agency leadership may be interested in this report that impacts the Federal workforce to address poor performers. Additionally, members of Congress and Office of Management of Budget employees along with individuals with an interest in Human Resources and civil service issues may be interested in this report. Students pursuing curriculum in the areas of human resources management, public administration, and industrial-organizational psychology may be interested in this report for research about civil service personnel practices.
