Summary:

The case concerns the strategic alliance formed by Uber Eats, the online food ordering and delivery platform of Uber Technologies Inc. (Uber), with Instacart Inc. (Instacart), which offers online grocery shopping services. The alliance's objective was to expand Uber Eat's presence in suburban regions of the United States, where Instacart had a strong presence. As per the terms of the partnership, an Uber Eats tab (i.e., a button) was to be made available on the Instacart platform, and Instacart+ (Instacart's membership program) members would benefit by being able to order food apart from groceries at no additional delivery charge. The food order had to be of a minimum value of USD 35. Analysts expected the Uber Eats-Instacart partnership to benefit restaurants as well. Uber Eats also formed alliances at multiple ends, hurting its alliance partners. In May 2024, Costco and Uber Eats expanded their partnership, wherein Costco members, even if they were nonmembers of Uber Eats, got a 15-20% discount on orders made on the Uber Eats platform. After this news of the alliance extension with Costco, the stock price of Instacart fell by 6%. Nevertheless, Uber's alliances, such as that with Walmart, have failed in the past.
