This case examines the urgent need for establishing neighboring rights for non-featured performers within the growing realm of interactive streaming platforms. Although current U.S. law and voluntary agreements between sound recording owners and digital service providers provide mechanisms for compensating featured artists and sound recording owners, non-featured performers remain largely unremunerated for their significant contributions to digital streams. Drawing on comparative analysis with international practices-such as Spain's equitable remuneration model-this case explores the economic, ethical, and regulatory implications of implementing a statutory framework in the United States that aligns with global standards and ensures fair compensation for all contributors to sound recordings. Students will be tasked with critically evaluating the feasibility of a statutory neighboring rights framework for non-featured performers in the United States, and weighing legal, economic, and ethical factors to develop an actionable and impactful policy strategy.
