- In England and Wales, juries are required to reach a verdict as a group. Due to restrictions on conducting real jury research, principally as a result of s.8 of the Contempt of Court Act, 1981, and issues with traditional, quantitative methodologies, such as a focus on individual, extra-legal factors, little is known about jury decision-making processes. This Case Study examines the use of a qualitative approach to jury decision-making (JDM) to collect rich, detailed data about the collective decision-making and group processes that were used in my PhD research. It explores how we can use a mock jury paradigm in a more realistic way to gather more in-depth information about how the jurors work together and reach their verdict decision. Replicating real trial procedures allows a deeper understanding of what may take place in the jury deliberations. The difficulties faced when employing this type of methodological approach, alongside the strengths of using it, are also discussed. The case study also suggests that this type of methodology could be used or adapted to study other societal groups and to collect group data.
