- The main key benefit of this book is its use of decoloniality in the examination of artisanal and small-scale mining (ASM) formalization. While there have been many cross-disciplinary explorations of formalization as a concept, the originality of this book lies not only in its interpretation of the law and history, but its decolonial approach to unpacking the historical roots of the dual mining economy and legal binary that birthed the contemporary criminalization of informalized local small-scale miners. Additionally, this book offers a novel approach to legal pluralism in the form of decolonial legal pluralism. After engaging with prevailing concepts of monist pluralism, pluralist pluralism and centrist pluralism, this book offers decolonial pluralism as a refreshing take on how formerly colonized countries, particularly those in Africa can reform their plural legal systems to suit modern realities. Finally, a key feature of this book is its reliance on indigenous knowledges systems. From its methodology to ethical considerations and proposals for legal and policy reform, this book presents Akan philosophies as central to knowledge-making. Relatedly, it offers the living customary law, not as an appendage but as integral to addressing the colonial entanglements and stunted developments in the ASM regulatory discourse.
