- La presente contribución corresponde al desarrollo del trabajo del profesor Thomas Gutmann Zurphilosophischen Kritik des Rechtspaternalismus que busca fundamentar la tesis según la cual no puede existir una teoría -o una crítica del paternalismo- sobre una base consecuencialista. En un marco normativo (moral o jurídico) que respeta al individuo como individuo y le asigna espacios protegidos de decisión individual, las intervenciones paternalistas son fundamentalmente problemáticas, es decir, necesitan ser fundamentadas, y deben ser limitadas. En este texto el autor señala que las actuales teorías consecuencialistas, particularmente todas las variantes del utilitarismo, fracasan en esa tarea.
