"This book addresses the tensions surrounding the right to individual self-determination within the realm of constitutional justice, specifically within the ongoing debate between liberals and communitarians regarding who is tasked with constructing the concept of virtue. By employing the principle of "freedom as recognition"—that is, the capacity to articulate a life plan within a community, even if that community might morally disapprove of it—the work demonstrates that a state incorporating liberal political principles is bound to maintain neutrality regarding its citizens' comprehensive conceptions of the good life. Accordingly, the book examines the argumentation employed in various judicial rulings on same-sex marriage across the Americas, analyzing each case through the lens of the aforementioned premises. The volume argues that traditions of moral and political philosophy share theoretical linkages with legal philosophy—and indeed with legal positivism itself, which may be characterized as a manifestation of modern moral thought. In this sense, the book reveals how theoretical debates from the late twentieth century concerning the societal construction of virtue have begun to take juridical form and yield material consequences in the early decades of the twenty-first century."
