Die ins nahezu Unüberschaubare gewachsene Ausbildungsliteratur enthält merkwürdigerweise immer noch eine Lücke bezüglich desjenigen Teils der Staatsprüfung, die von vielen Kandidaten als besonders angsterregend angesehen wird. Es handelt sich dabei um die mündliche Prüfung. An diesem einen Tag kann sich zuviel entscheiden, als dass man ihm mit Gelassenheit entgegen sehen könnte. Zudem erscheint die Prüfungssituation selbst völlig unkalkulierbar. Dass die bisherige Ausbildungsliteratur so wenig zu diesem Themenkreis bereithält, mag damit zusammenhängen, dass die Zahl der vielen unterschiedlichen Prüfungsgespräche so unterschiedlich ist, wie es verschiedene Prüfer gibt. In der Tat gilt als bisher einzig empfehlenswerter Weg die zielgenaue Vorbereitung auf den jeweiligen Prüfer anhand von bekannten Protokollen über frühere Prüfungen. Dabei wird man freilich nicht selten enttäuscht, weil sich nicht alle Prüfer als gleichermaßen "protokollfest" erweisen. Die vorherige Lektüre nimmt im übrigen der mündlichen Prüfung wenig von ihrer Unvorhersehbarkeit und Unkalkulierbarkeit. Daher geht die vorliegende Darstellung einen anderen Weg. Zunächst werden einige allgemeine Bemerkungen über die mündliche Prüfung und die Situation, in der sich der Kandidat befindet, vorangestellt. In diesem Rahmen wird versucht, Handlungsanweisungen zu geben, die sich für alle Arten der mündlichen Prüfung, und damit auch gegenüber allen Prüfern, empfehlen. Sodann sollen einige Prüfungsgespräche skizziert werden. Dabei handelt es sich nicht um "echte Prüfungsgespräche", sondern es sind fingierte, die zudem die Wiederholung des Pflichtfachstoffs ermöglichen sollen. Prüfer und Kandidat sind demgemäss idealtypische Figuren, welche die möglichen Situationen, in denen man sich in der Prüfung befinden kann, möglichst authentisch aufzeigen sollen.

["The oral examination of the first law state examination"]The immense quantity of study literature surprisingly still presents an enormous gap regarding the part of the state examination that many exam candidates are particularly afraid of: the oral examination. This single day is too important for your studies to await it with calm. In addition, the examination situation itself seems to be completely incalculable. The fact that the existing study literature provides extremely few publications on this subject may be due to the fact that the many different examination conversations are as diverse as the number of examiners. In fact, the only recommendable method of targeted preparation as regards the respective examiner was to study the protocols of previous examinations. Following this approach, many candidates have already been disappointed, as not all of the examiners turned out to be "true to the protocol". Moreover, despite this form of studying, the oral examination does not loose much of its unpredictable and incalculable character. This is why the present description opts for another approach. To start with, some general remarks are made on the oral examination and the candidate's situation. In this manner, the author tries to give instructions on how to conduct yourself which can be recommended for any type of oral examination and accordingly for any examiner. So some exam conversations are outlined. These are no "authentic exam conversations", they are fictitious and in addition meant to permit the repetition of the learning material of the compulsory subjects. Accordingly, the examiner and the candidate present ideal figures, the objective of which is to show possible examination situations as authentically as possible.
