El debate nace desde el punto mismo de la definición de derrotabilidad de la norma, pues Bayón básicamente afirma que las excepciones que la norma va adquiriendo después de ser emitida favorecen la reconstrucción de las prácticas jurídicas corrientes. Por el contrario, Rodríguez piensa que si no se establecen las condiciones suficientes no se puede derivar solución normativa alguna.
