- "Penalties involving the deprivation of rights—specifically, forms of disqualification—are defined in terms of specific, enumerated rights: the right to practice a profession or trade, or to hold public office or employment. Nevertheless, through a series of successive reforms, Book II of the Spanish Penal Code has gradually introduced a range of specific—or *ex novo*—legal consequences. These have been incorporated as distinct manifestations of the general principles already established in Book I of the Code. Prominent among these are penalties involving the deprivation of specific rights—that is, forms of disqualification that specifically target the loss of certain rights or activities in connection with particular offenses, or that result in the deprivation of other rights explicitly enumerated (*ex novo*) within Book II of the Penal Code. However—whether in the provisions governing the scope of absolute disqualification, in the general references to special forms of disqualification, or in the regulations applicable when such penalties serve as accessory sanctions—the Penal Code empowers the presiding judge, by means of a statutory "catch-all" clause, to impose special disqualification regarding *any* "other right or activity." This study proceeds from a conceptual distinction between the aforementioned penalties involving the deprivation of specific—or *ex novo*—rights under Book II (which are already explicitly enumerated) and those penalties involving the disqualification—whether absolute or special—of "other," unenumerated rights. This latter category of penalties holds particular significance within the context of the Crown, as further elaborated in the present work." -- Back cover (translates).
