- "The fundamental purpose of this study is to analyze the objective termed "danger to the community"—stipulated in Article 310 of the Code of Criminal Procedure (CPP)—as one of the prerequisites permitting the restriction of liberty through preventive detention during the early stages of the criminal process. This requirement was examined by constitutional jurisprudence in Judgment C-469 of 2014, through which the Constitutional Court affirmed its conformity with our Constitution. Notwithstanding its constitutionality, this provision stands in paradoxical contrast to the stipulations of the American Convention on Human Rights (ACHR), the jurisprudence of the Inter-American Court of Human Rights (IACtHR), and the doctrine of the Inter-American Commission on Human Rights (IACHR); for these bodies have long rejected said objective as a valid ground for limiting the fundamental right to liberty through the application of precautionary measures. This situation results—among other consequences—in the Colombian State evading its international obligations, despite having entered no reservations whatsoever at the time of signing the aforementioned pact." -- Publisher (translated).
