Summary:
"A telematic hearing is any procedural action before a court with the intervention of two or more people, in which at least one of them is not in the same physical space and which is carried out by means of a technological communication system that allows the act to be held with the same rights and the same guarantees as it would be held if it were held at the headquarters of the Judicial Office and in the presence of the Judicial Office of all the participants. This monograph carries out a complete study of hearings held electronically, from their origins to their most recent regulation through RDL 6/2023 (Title VIII: Procedural Efficiency Measures of the Public Justice Service). All its practical and technical aspects, advantages and disadvantages, the determination of the cases in which it is appropriate to hold it, the rules of decorum, the presentation of pleadings and documents at the hearing, etc., are examined in detail. In the same way, an approach to the subject is carried out from the international and comparative perspective, as well as within the framework of international legal cooperation. Finally, it is worth highlighting, by way of an epilogue, the consideration of the possible uses and future developments of artificial intelligence in the administration of justice in Spain. An exhaustive analysis of telematic hearings and the most relevant aspects for all legal operators involved is carried out, such as lawyers, solicitors, experts, judges and magistrates, Lawyers of the Administration of Justice (LAJs), and personnel at the service of the administration of justice. This analysis covers, among other issues of special practical interest, the systems of identification, management, recording, presentation of documents and coordination with the judicial file." -- Publisher (translated).
