Summary:
«The arbitral award is the outcome of arbitral proceedings during which the parties may have presented opposing facts, views and arguments. One of the main concerns of the stakeholders in these proceedings is to detect dishonesty or disinformation, but is this sufficient to establish the truth? Is the truth multifaceted or plain?0After an introductory essay, a Belgian and a Dutch practitioner jointly analyse the instruments available for parties, for counsel and for arbitrators, their use and effectiveness. These combined Belgian and Dutch approaches enlarge the perspectives for understanding the structured but antagonistic dialogue. Moreover, common law and civil law developped different instruments for searching the truth, and a further report by a Belgian and a Dutch practitioner examines how guidelines and rules assist in streamlining this process and in guaranteeing the independence and impartiality of arbitrators. The final word addresses the users of international commercial arbitration. What are their expectations as to the truthfulness of the arbitral award? »--Quatrième de couverture.
