Summary:
A German-Dutch comparative analysis in criminology on law, state-law and police-law aspects.
The investigation starts with the problem of coping with the consequences of judicial overload in German criminal proceedings. As a way out of the existing work overload of the courts and public prosecutor's offices due to the increasing number of criminal proceedings capable of being judged, it is advisable to transfer the powers of the public prosecutor's office in the field of petty crime to the police. This could create more work capacity in the area of ​​serious crime for public prosecutors. The work deals with the interaction between the public prosecutor's office and the police in the field of criminal investigation as well as the decision-making decisions in German and Dutch criminal proceedings. It results in a legislative proposal based on Dutch criminal proceedings, which in the field of minor crime allows the police to be empowered to end the procedure with a monetary requirement. The author is a research assistant at the Department of Criminology - Department for Criminology, Juvenile Criminal Law and Correctional Services - Georg-August-Universität Göttingen.
