- According to the Non-Punishment Principle (NPP), which is based on international guidelines, victims of human trafficking should not be punished for crimes committed in connection with human trafficking under certain conditions. This principle has been explicitly incorporated into German criminal law in Section 154c (2) of the Code of Criminal Procedure. Using a legal-dogmatic and empirical-criminological analysis, this paper examines the NPP in detail, focusing in particular on whether and to what extent the NPP is a legally binding principle, whether it is sufficiently reflected in German law, and how this principle is applied in practice.
- Nach dem auf internationalen Vorgaben beruhenden Non-Punishment-Prinzip (NPP) sollen Opfer von Menschenhandelstaten fuÌr Straftaten, die sie selbst im Zusammenhang mit dem Menschenhandel begangen haben, unter bestimmten Voraussetzungen nicht bestraft werden. Eingang in das deutsche Strafrecht hat dieses Prinzip explizit durch § 154c Abs. 2 StPO gefunden. Die Studie befasst sich im Wege einer rechtsdogmatischen und empirisch-kriminologischen Analyse eingehend mit dem bislang wenig behandelten NPP, namentlich mit den Fragen, ob und inwieweit es sich bei dem NPP um ein rechtlich verbindliches Prinzip handelt, ob das deutsche Recht ihm ausreichend Rechnung traÌgt und wie dieses Prinzip in der Praxis Anwendung findet.
