This work examines the process of judicial decision-making. The interest is directed to those steps in the decision-making process of the Swiss Federal Supreme Court that go beyond the classical legal methods. In this context, the specific relevance of constitutional law, which regulates the decision-making process, as well as the decisive importance of precedents become apparent. In particular, the author illuminates the reception of precedents by means of judicial case decision rules, so-called precedential considerations, and their significance for the interpretation of norms. The analysis is carried out in the area of fundamental rights, with a presentation of the reception process of the case law of the ECtHR, as well as with a comparative analysis of US case law. The aim of the work, which is addressed to academics as well as to members of the courts and authorities, is an expansion of the doctrine of methodology in the light of current supreme court practice. Das Werk untersucht den Erkenntnisprozess richterlicher Entscheidfindung. Das Interesse richtet sich auf jene Erkenntnisschritte bundesgerichtlichen Entscheidens, die über die klassischen juristischen Methoden hinausgehen. Dabei zeigt sich eine spezifische Relevanz des Verfassungsrechts, das die Entscheidfindung normiert, wie auch die massgebliche Bedeutung von Präjudizien. Die Autorin beleuchtet insbesondere die Präjudizienrezeption mittels gerichtlicher Fallentscheidungsregeln, sog. Präjudizieller Erwägungen, und deren Bedeutung für die Norminterpretation. Die Analyse erfolgt im Bereich der Grundrechte unter Darlegung des Rezeptionsprozesses der Rechtsprechung des EGMR sowie unter rechtsvergleichender Analyse des US-Case Law. Ziel der Arbeit, die sich an die Wissenschaft wie auch an Gerichts- und Behördenmitglieder richtet, ist eine Erweiterung der Methodenlehre im Lichte der aktuellen höchstgerichtlichen Praxis.
