- Last month, in the first lawsuit of its kind, the U.S. Equal Opportunity Commission sued the Burlington Northern Santa Fe Railway for genetic discrimination. It charges that the railroad was surreptitiously testing its employees for a genetic predisposition to a painful and common workplace injury called carpal tunnel syndrome, in an effort to avoid paying employees' medical bills and reimbursing them for lost time.
