- El derecho a la intimidad sigue siendo, siglo y medio después, una práctica en busca de una teoría. La sensación del investigador o del profesional que se acercaa su estudio se encuentra con una triple barrera de entrada: la constante colisión con otros derechos fundamentales (libertad de expresión vs. derechos de la personalidad, lo que ahonda en su perspectiva constitucional), la interrelación de límites insalvables con la irrupción de nuevas realidades (intimidad y protección de datos; intimidad y seguridad; intimidad y propiedad intelectual, lo que ha llevado ya a alguna doctrina extranjera a hablarde «privacidad intelectual»), y la certeza de que estamos ante un derecho inabordable (pésima regulación legal y dubitativa jurisprudencia,legislador hiperactivo -nacional, europeo, etc.-, universalización jurídica...), por sus múltiples aristas. Pues bien, la únicaforma de ordenar su adecuada confección jurídica es recaudir al clásico de Warren y Brandeis, el artículo científico más leído de la Historia del Derecho; en ese sentido, este trabajo sigue siendo insuperable.
