- La presente monografía tiene su origen en las varias contribuciones y reflexiones que los diferentes intervinientes aportaron en el Congreso Nacional sobre Las personas con discapacidad intelectual. Su problemática jurídica, celebrado en la Facultad de Derecho de la Universidad Complutense de Madrid, los días 24 y 25 de febrero de 2022, y organizado por el Instituto de Derecho Comparado de esa Universidad.La temática de la presente monografía viene justificada por la entrada en vigor de la Ley 8/2021, de 2 de junio, por la que se reforma la legislación civil y procesal para el apoyo a las personas con discapacidad en el ejercicio de su capacidad jurídica. Esta norma, junto con otras que le precedieron en el tiempo, ha supuesto una trascendental modificación no solo en las diferentes disposiciones legales afectadas, sino también en la concepción de determinados postulados tradicionales en relación con las personas físicas.La concreción del tema se fundamenta en que, de entre las personas con discapacidad concernidas por la nueva normativa, las afectadas por una discapacidad intelectual son, probablemente, las que plantean una más abundante problemática, cuyos temas medulares son analizados por los diferentes autores a través de los temas que se recogen en esta monografía, que se inicia con dos aportaciones: La «voluntad, deseos y preferencias» de la persona con discapacidad, y La función notarial tras la entrada en vigor de la ley 8/2021, por ser dos de los temas principales en el marco de la nueva normativa.Para ordenar cabalmente el resto de los textos, se han agrupado en las siguientes líneas temáticas:Protección constitucional de las personas con discapacidad.Novedades procesales de la Ley 8 /2021, de 2 de junio.Capacidad negocial de las personas con discapacidad intelectual.La guarda de hecho de las personas con discapacidad.Poderes generales y poderes preventivos otorgados por personas con discapacidad.
