- Históricamente, los sistemas jurídico-políticos europeos y, por extensión, americanos, han tenido que experimentar agitaciones de violencia y contrapoder, y se han protegido mediante respuestas legislativas, gubernativas o judiciales, así como han articulado medidas de prevención junto a las de represión. Toda sociedad vertebrada ha sentido el impulso de un trastrueque, de una inversión axiológica o de un estallido de descomposición, condicionado o utópico. Cabe entonces aproximarse con interés a las formas de legitimación y consumación de los terremotos sociopolíticos que perseveran en la conservación o en la mutación de determinadas formas jurídicas, y sobre todo tratar de comprender cuál ha sido el razonamiento o el análisis desarrollado sobre la cuestión por la literatura política y jurídica en su sentido más amplio, además de la política de control criminal o administrativo, y de la eficacia o frustración bien definitiva, bien temporal, tanto de los instrumentos de orden cuanto de los amagos y arrebatos de desorden, sin caer en el olvido de la construcción de las ideas que, amparadas en la certidumbre o en la tergiversación, se elaboran al servicio de afectos y desafectos.
