本书对非物质文化遗产法律保护的一般性问题作了梳理,用对比的方法对国内外保护现状和问题进行讨论,并基于文献和调查资料对我国非物质文化遗产保护现状和存在的问题作了分析,提出了一些解决方案.同时不回避法律保护中的重点和难点问题,诸如对非物质文化遗产范围,权利主体,权利性质的确定;其与知识产权客体的法律保护的比较中,指出其客体突破了传统法律关系的客体的形态范围,得出不同的私权主体,具有不同的私权权利的结论;在其公法与私法在保护问题上,提出公法为主,私法为辅的保护模式,这是法律调整的复杂对象以及对象内在结构关系使然,并从公,私法两方面对"非遗"保护可能涉及的部门法立法建构作了尝试性的讨论;对其法律制度建构的基本原则和立法问题论述中,特别是在法律视角下对其保护定义中的分类标准进行探索性讨论,并以特例的形式予以展现等等.最后从法哲学的视角对其法律保护中的不良倾向的矫正,世界意识与新观念的确立作了整体性分析,目的是为其保护行动提供思想上的可能性. -- Source other than Library of Congress.
