Summary:
The principles and methods discussed in Chapters 2 and 3 are good engineering science, but they are only of academic value unless they can be applied for a business purpose. Analysis and improvement of system designs is one such purpose. Another purpose may be to conduct a safety systems performance analysis for purposes of litigation issues. A third purpose may be to document vehicle conditions at the time of a crash event (such as when the vehicle under examination has struck another vehicle). Chapter 4 discusses various publicly and privately known EDR data content and considerations for submitting such data as evidence in a litigation environment. Among these considerations are the Daubert criteria: (1) reliability, (2) repeatability, (3) error rate, (4) consistency with industry standards, and (5) relevance to the instant case. Lastly, Chapter 4 provides new investigation examples which employ methods designed to meet foreseeable Daubert challenges.
