Biography/History:
Rabbinical figure in Modena (died before 1832), and student of Ishmael ben Abraham Isaac ha-Kohen of Modena (1723-1811; his teacher's work of responsa, זרע אמת, volume 3 (Reggio: Elḥanan Ḥai Kohen, [1823]) carries his introduction, under the pseudonym פ'ל'א'י', an acronym of his name (see Judges XII:18)); Pesaḥ was in possession of some of his teacher's manuscripts (the posthumous first edition of Ishmael ha-Kohen's sermons, שפת אמת (Livorno: Mosheh Yeshuʻah ben Yaʻaḳov Ṭoviana, 1832), in the introduction by 'Azariyah Ḥayyim Sanguinetti (title page verso, final paragraph)).
Summary:
Responsa from Yosef Eliyahu Pesaḥ to Hananel (Graziadio) Neppi, rabbi of Ferrara, debating his decision regarding the circumcision of a child on the Sabbath who was born with two foreskins (שתי ערלות; circumcision is generally carried out on the Sabbath, superseding Sabbath's prohibitions), which had occurred. Pesaḥ argued against the allowance of the practice, especially citing סכנה (suspicion of peril, here in reference to the second foreskin), not allowed on the Sabbath even in cases of canceling the circumcision ceremony, and argued against Neppi's defenses and citations (chiefly Maimonides, Mishneh Torah, Shegagot 2:8 passim). Document hinge-left (and each column reads non-consecutive); "registrata" written below autograph; addressed and notarized on former document dorse (now pressed flat; f. 2v).
