- Summary:
- This is a manuscript, written in northern Italy, circa 1750, consisting of prayers and piyutim, many of them uncommonly found in manuscript. The first is titled Seder Mesirat modaʻah (a general term for an oral testimony in court), and the text is a confession and renunciation, recited before a Beth Din, for the sin of wasting seed (עון הוצאת זרע לבטלה); while the text was composed by Jonathan ben Jacob of Ofen (17th century) based on the text of Hatarat nedarim (annulment of vows) and appearing in his book, Ḳeset Yehonatan (Dyhernfurth: Shabtai Bass, 1697; p. 13r-14r), further recommended by R. Elijah ha-kohen of Smyrna (Sheveṭ musar, ch. 27), this instance shows its actual use in court, as the scribe changed the text to address three judges (לשון רבים) with the original text of the prayer (לשון יחיד) written in minuscule above each changed word. The renunciation includes references to the seduction of Adam by Eve in the Garden of Eden as the moment God invented the fires of Gehenna (f. 1r), the demonic angels "bringing to [the deceased] many vermin from wormwood... to slaughter him with a great knife, and to turn him into coals, Heaven forfend..." (f. 1v), and the abjuration of the sin by the court ( "ʻedah kulah"), in communion with God, absolving him of guilt of the sin and licentious thoughts, and any torture after death ("מחרימים אנחנו בית דין בצירוף קודשא בריך הוא"; f. 3v). Following this is a list of supplementary texts for one who is unable to pray with a quorum (and therefore is unable to hear Kaddish, or recite Barekhu and Ḳedushah) consisting of Baraitot and variants of Kaddish for personal recital (such as f. 8r); perhaps suggesting that the manuscript was written for a sparsely populated community. Following this is the piyut אתה כוננת עולם מראש, describing the Yom Kippur service in the Temple of Jerusalem, to be recited during the chazzan's repetition of Musaf on Yom Kippur, attributed to Yose ben Yose (Palestine, 4th century; f. 14r-20r), with variants written in the margins.
