Summary:
This case starts by reviewing the federal minimum wage for covered non-exempt employees which is currently $7.25 per hour effective July 24, 2009. The federal minimum wage provisions are contained in the Fair Labor Standards Act. Many states also have minimum wage laws. In cases where an employee is subject to both the state and federal minimum wage laws, the employee is entitled to the higher of the two minimum wages. Based on these laws, the case then reviews the current movement to increase the minimum wage to $15 an hour. Walmart is used as an example to determine the effect of raising the minimum wage in states such as California to $15 an hour.
