- Provides overview of the Pregnancy Discrimination Act (PDA), which prohibits pregnancy discrimination in employment; and provides background on Young volumes United Parcel Service , in which a United Parcel Service (UPS) worker challenged UPS refusal to grant her a light-duty work assignment while she was pregnant, claiming that this violated the PDA. Analyzes Supreme Court ruling in Young , in which the Justices fashioned a new test for determining when an employer's refusal to provide accommodations for a pregnant worker constitutes a violation of the PDA, and sent the case back to the lower court for reconsideration in light of these new standards. Considers implications of Supreme Court decision, and considers potential legislative response.
