Summary:
Discusses technology used by Aereo and FilmOn X, both of which stream television programming over the Internet for a monthly subscription fee. Examines the Copyright Act of 1976, which provides copyright holders with the exclusive right to control how certain creative content is publicly performed; and discusses the transmit clause, which determines whether a performance is private or public and within scope of the public performance right. Reviews interpretation of the transmit clause and public performance right by courts in WNET volumes Aereo and Fox Television Stations volumes FilmOn X . Reviews future litigation and related legislative proposals in the 113th Congress.
