Summary:
Provides background, historical context, and interpretation of an 1866 Public Law referred to as Revised Statute 2477 (R.S. 2477) that granted rights of way across unreserved federal lands for construction of highways, and which was repealed under the Federal Land Policy and Management Act (FLPMA) in 1976. Examines validation issues related to pre-1976 R.S. 2477 rights of way claims, including disclaimer provision of Section 315 of FLPMA and a memorandum of understanding between the Department of Interior and Utah which established a process by which R.S. 2477 rights of way on certain federal lands can be validated and a disclaimer to them issued by the U.S.
