Summary:
Examines State sovereign immunity from private lawsuits under Eleventh Amendment, and reviews substantive provisions of H.R. 3204 and S. 1611, both the Intellectual Property Protection and Restoration Act, to provide incentives for States to waive immunity in intellectual property infringement cases, create standards for abrogation of State sovereign immunity, and define State employees engaging in illegal activities as culpable for violations of Federal law, notwithstanding State sovereign immunity.
