Summary:

Compiles court decisions in cases challenging Endangered Species Act (ESA) provisions that restrict the use of privately-owned land and whether restrictions on land use and other property-related activities imposed under ESA effect a taking of property under the Fifth Amendment. Addresses four kinds of ESA measures covered by the cases, including prohibitions on land uses that might adversely affect species listed as endangered or threatened; reductions in water delivery to preserve instream flows; limits on defensive measures a property owner may take to protect property from listed animals; and limits on commercial dealings in members of a species acquired prior to listing.
