Summary:
Provides a legal analysis of State authority to regulate prorationing (production limits) of natural gas on a statewide basis. Addresses whether such proposals are a valid exercise of State police power and within the scope of permissible State activity under the Commerce Clause of the Constitution. Examines whether State authority to regulate is preempted by the Natural Gas Act of 1938 and the Natural Gas Policy Act of 1978, and outlines related case law and State laws.
