Report, prepared by Morton Rosenberg (CRS) for the Subcom on Oversight and Investigations, analyzing President Reagan's Feb. 17, 1981 Executive Order 12291 (text, pages 75-79), imposing certain substantive and procedural requirements on executive branch agencies rulemaking, and giving OMB oversight authority in the rulemaking process.
Reviews legal basis for the order, as contained in Justice Dept Feb. 13, 1981 memo (text, pages 80-83), and considers constitutional issues and legal precedents regarding the President's role in the regulatory process.
