- The comparatist's gaze to the law starts from an external point of observation. It is the gaze of those who contemplate law in its structure, but also in its function; in its consideration as a set of precepts, but also of institutions that put them into action to imperatively distribute goods and values. It is the gaze of those who, more than law, examine the legal experience, both in its empirical dimension and in its essence of discursive practice. This is since the birth of comparison as an autonomous science at the beginning of the 20th century, when it appeared in the stage of legal knowledge to refound it on critical bases: to dislocate the unique conventions and thoughts, such as the legicentrism and dogmatism typical of the prevailing scientific paradigms at the time. Hence the identity of the comparatist as a scholar called to analyze the phenomenon of law immersed in its space-time dimension, thus valuing the interactions between law and the other social sciences.
