Discusses ongoing criminal case of Jamshid Muhtorov, a permanent resident, who is challenging constitutionality of expanded foreign surveillance program authorized under Section 702 of the Foreign Intelligence Surveillance Act (FISA) of 1978, amended by the FISA Amendment Act in 2008, which collected evidence against him in a case where he is accused of providing material support to the Islamic Jihad Union in violation of Federal law.

Under FISA Section 702, the Department of Justice and the Office of the Director of National Intelligence can jointly authorize, for a period of up to one year, the warrantless acquisition of the contents of certain communications if the target of the surveillance is a non-U.S. person who is believed to be overseas at the time of acquisition.
