- Discusses D.C. Circuit Court ruling in Noel Canning v. National Labor Relations Board that the President can make recess appointments only during intersession recesses, and that such appointments can be made only to vacancies that have occurred during the recess in which the appointment is made. Considers impact that Noel Canning might have had on recess appointments made since January 20, 1981, the beginning of the Ronald W. Reagan Administration, had the Noel Canning decision preceded these appointments. Presents data on recess appointments during that period, and considers which of these appointments might have been affected by the first determination of the court, which precludes intrasession recess appointments.
