- Examines issues and concerns regarding foreign direct investment in the U.S., focusing on the Exon-Florio provision of the Defense Production Act, which provides the President with authority to block the acquisition of U.S. firms by foreign investors upon determination by the interagency Committee on Foreign Investment in the U.S. (CFIUS) that the acquisition threatens national security. Reviews Department of Treasury regulations; the "Byrd Amendment," which requires CFIUS to investigate certain proposed mergers, acquisitions, or takeovers; subsequent amendments made to the CFIUS process; CFIUS caseload; and recent transactions.
