- Discusses FDA failed attempt at regulating tobacco products under provisions of the Federal Food, Drug, and Cosmetic Act; summarizes current FDA tobacco rule reissued to reduce underage smoking and use of smokeless tobacco products; and compares provisions of reissued rule to youth access, advertising, and marketing restrictions that went into effect pursuant to the 1998 Master Settlement Agreement between the States and tobacco companies. Discusses First Amendment implications of advertising restrictions in the rule, including analysis of recent Federal district court ruling against FDA and Supreme Court decision in Lorillard Tobacco Co. v. Reilly , which struck down Massachusetts law restricting outdoor tobacco advertising.
