- Examines constitutional and statutory protections related to free exercise of religion, including current Supreme Court interpretations, as well as judicial and legislative avoidance of defining parameters of religious belief, in light of Affordable Care Act (ACA) requirement that employers provide contraceptive coverage to employees under a group health plan. Discusses significant examples of existing religious exemptions in current law, including employment nondiscrimination, health care, and public accommodations law. Analyzes recent Federal judicial decisions that have considered religious freedom rights of commercial entities whose owners have religious objections to the ACA contraceptive coverage requirement.
