- Provides overview of public charge grounds of inadmissibility and deportability of aliens. Examines statutory basis for public charge grounds under the Immigration and Nationality Act, and reviews seminal administrative and judicial decisions construing the meaning of public charge. Summarizes the Personal Responsibility and Work Opportunity Reconciliation Act (PRWORA) and resulting guidance defining public charge and describing application of public charge grounds. Outlines DHS and Department of State regulations and other guidance following enactment of PRWORA, addressing questions about aliens who receive public benefits under PRWORA. Discusses why previous or present receipt of public benefits by an alien would generally not suffice to result in the alien being found to be removable under current law.
