- Surveys background of the Alien Tort Statute (ATS), which provides district courts with jurisdiction over any civil action by an alien for a tort only, committed in violation of the law of nations or a treaty of the U.S. Analyzes past 30 years of ATS case law, tracing judicial interpretation of corporate liability. Examines Supreme Court decision in Kiobel v. Royal Dutch Petroleum Co. regarding whether corporations can be held accountable for human rights violations under the ATS. Reviews arguments made by majority and concurrences about extraterritorial application of the ATS; history, text, and purposes of the act; and the "touch and concern" test. Surveys possible implications of Kiobel decision on pending and future cases, and considers possible Congressional responses to the Court invocation of the presumption.
