Examines Decker v. Northwest Environmental Defense Center , addressing whether logging road runoff from rain or snow requires a permit under the Clean Water Act. Provides statutory and regulatory background of Decker , and describes Supreme Court decision supporting long-standing EPA reading of its Industrial Stormwater Rule stating that logging road runoff, even if channeled, does not require a National Pollutant Discharge Elimination System permit.
