- Provides overview of Administrative Procedure Act, which prescribes the procedures that Federal agencies must undertake in order to promulgate agency rules. Addresses Supreme Court ruling in Bowles v. Seminole Rock & Sand Co. , which declared that agencies are entitled to significant deference when they are interpreting their own regulations. Discusses how courts currently treat Federal agency interpretations of their own ambiguous regulations, and examines arguments raised in recent Supreme Court opinion from Decker v. Northwest Environmental Defense Center , in which some members of the Court indicated a willingness to reconsider Seminole Rock deference. Presents justifications for and arguments against maintaining this judicial deference.
