- Explores issues and challenges associated with FAA integration of unmanned aircraft systems (UAS) into national airspace system by Sept. 2015, as mandated under the FAA Modernization and Reform Act of 2012. Describes regulatory framework for permitting use of unmanned vehicles and the potential rulemaking that will occur over the next few years. Discusses theories of takings and property torts as they relate to drone flights over or near private property. Examines privacy interests implicated by drone surveillance conducted by private actors and potential countervailing First Amendment rights to gather and receive news. Explores possible Congressional responses to these privacy concerns, discusses how FAA has approached these concerns, and identifies additional potential legal issues.
