- Discusses two-step inquiry fashioned by lower courts to analyze provisions under the Second Amendment. Highlights how this test has been employed on firearms laws that limit Second Amendment rights of certain individuals, concealed carrying laws, and other State laws. Explains Supreme Court ruling in D.C. v. Heller , which held that the Second Amendment to the U.S. Constitution protects the individual right to possess a firearm, unconnected with service in a militia, and use of that firearm for traditionally lawful purposes, such as self-defense within the home. Considers how varied lower court interpretations of the Heller decision may affect burden upon Federal Government to defend firearms provisions, and considers other potential analytical frameworks.
