- Examines constitutional issues surrounding applicability of the Chemical Weapons Convention Implementation Act, enacted to implement the Convention on Chemical Weapons, to the Supreme Court case of Bond v. U.S. , in which the petitioner argues that use of the Federal implementing statute in a "run of the mill" assault case exceeds the legislative power of Congress under the Necessary and Proper Clause of the Constitution. Provides background on the case, reviews constitutional and application challenges, and considers implications of Supreme Court ruling for scope of Presidential treaty making power and Congressional authority to enact treaty implementing legislation.
