- Summarizes constitutional arguments made for and against State and local economic sanctions against individuals and firms that do business with or in foreign countries whose conduct the jurisdictions find objectionable. Discusses Supreme Court decisions in Crosby v. National Foreign Trade Council and American Insurance Association v. Garamendi , which held that such State laws were preempted by Federal laws; and reviews Federal district court decision in National Foreign Trade Council v. Giannoulias , which held that an Illinois Sudan sanctions law was unconstitutional. Covers Federal Circuit Court decision in Faculty Senate of Florida International University v. Winn , which held that States can restrict use of funds to sponsor travel by State education employees to specific countries for national security reasons. Addresses ongoing legal and practical concerns, and summarizes recent Federal enactments pertaining to Sudan and Iran.
