- Provides detailed analysis of Section 907(a)(1)(A) of the Family Smoking Prevention and Tobacco Control Act (Tobacco Control Act), which bans the sale of all flavored cigarettes, except menthol cigarettes. Examines this provision in light of a challenge to the Tobacco Control Act ban on non-menthol flavored cigarettes brought before a World Trade Organization panel by Indonesia, a major producer of clove cigarettes, claiming, among other things, that it violated the Agreement on Technical Barriers to Trade. Discusses U.S. response to WTO Appellate Body ruling that the Tobacco Control Act ban of non-menthol flavored cigarettes treats imported clove cigarettes less favorably than domestic menthol cigarettes and constitutes discrimination.
