Summary:
Examines source of Congressional contempt power, reviews historical development of early case law, outlines statutory and common law basis for Congressional contempt power, and analyzes procedures associated with inherent contempt, criminal contempt, and civil enforcement of subpoenas. Discusses both non-constitutional and constitutionally based limitations on the power. Addresses significance of House Judiciary Committee dispute with the White House over the dismissal of several U.S. attorneys that resulted in votes for criminal contempt of Congress and the U.S. district court opinion in Committee on the Judiciary v. Miers .
