- Discusses recent Supreme Court and selected lower court rulings on issues arising under the Individuals with Disabilities Education Act (IDEA) of 1975, which provides Federal funding for education of children with disabilities, and requires the provision of a free appropriate public education (FAPE). Discusses definition of a disability, "child find" requirement, FAPE, individualized education program, interpretations of related services, "least restrictive environment," interpretation of "stay-put" provision in the due process requirements, seclusion and restraints, retaliation and harassment, due process procedure, parental rights, Section 504 and the Americans with Disabilities Act, burden of proof regarding an allegedly inadequate individualized education program, remedies, attorney fees, expert witness fees, and systemic compliance complaints.
